Speaking of the glorious yet short-lived Free Territory of Trieste, the Special Rapporteurs have created a proposal for an international law exam question:
A pirate submarine has docked on the ocean floor beneath the border between high seas and the EEZ of the Argentinian claim to Antarctica. The submarine itself is located within the hypothetical EEZ, while its docking cable is fastened a few meters away, beneath the high seas. The submarine is registered in Somaliland, and carries the Somiland flag, although only inside the vessel. The pirates’ nationalities are: 1 stateless person, 1 from Kosovo, 1 Palestinian, the president of Taiwan and the Dalai Lama (both of whom invoke sovereign immunity), and one person who was born in the Territory of Trieste before it was dissolved and who has not updated his passport. A French-British NATO patrol under a limited UN authorisation tries to seize the submarine using force, claiming that the ECHR does not apply.
